Our trademark infringement process is for the infringement of hosted content. In this case, the content is contained on a customer maintained dedicated server. Our only course of action is to suspend the customer's dedicated server to prevent the domain from resolving and displaying the infringing hosting account content.
We will not remove the hold on the account until one of the following occurs:
The complaining party provides authorization
The hosting customer provides us with a valid counterclaim (see trademark infringement policy)
The domain no longer resolves to the hosting account content (i.e.: domain is parked or pointing to another location).
As we have indicated previously a trademark infringement claim does not affect the domain registration or the customers' ability to manage it.
We make no representation that the customer will not infringe on any trademarks, but will take appropriate action, when notified of a possible content infringement issue for sites hosted with our service.
